Terms of Service

1. General Terms

These terms of service ("Terms") govern your use of Bytastartplats.se ("Platform") operated by Startex AB ("we" or "us"). By using the Platform, you accept the Terms in their entirety.

2. Platform Purpose

Bytastartplats.se is a digital marketplace that enables users to buy and sell race entries to sporting events. We act as an intermediary and provide secure payment solutions and verification processes.

3. User Responsibility

3.1 General Responsibility

  • You must be at least 16 years old to use the Platform
  • You are responsible for keeping your account details secure
  • All information you provide must be accurate and current
  • Users must complete all steps in the purchase or sale process within specified deadlines

3.2 For Sellers

  • You must own the race entry you are selling
  • You are responsible for completing the name change within 32 hours
  • You must follow the event organizer's rules for name changes
  • You may only sell entries to approved races

3.3 For Buyers

  • You are responsible for confirming receipt of the race entry
  • You must report problems within 32 hours
  • You are responsible for meeting the event organizer's requirements

4. Payment Terms

4.1 Pricing

  • Buyers pay the entry price plus a minimum service fee of 40 SEK
  • When paying the seller, a seller fee of at least 40 SEK is deducted from the listing price
  • Any name change fees to organizers are paid separately in accordance with the organizers' terms and instructions for name changes

4.2 Payment Process

  • All payments are processed through Stripe
  • Funds are held securely until the transaction is completed
  • Automatic refunds for failed transactions
  • All payments are covered by [Stripe's Connected Account Agreement], which includes [Stripe's Terms of Service]. By using the Platform, you agree to be bound by Stripe's terms and that these terms may be changed by Stripe from time to time

5. Deadlines and Timeframes

Important deadlines:

  • 32 hours: Seller must complete name change, otherwise the full amount will be refunded to the buyer
  • 32 hours: Buyer must confirm receipt or report problems, otherwise payment is automatically released to the seller
  • Automatic actions are taken for missed deadlines

6. Refunds and Complaints

6.1 Automatic Refunds

If the name change has not been completed within 32 hours, for example due to technical problems or the seller failing to take the necessary steps to complete the name change, the buyer's payment for the race entry will automatically be refunded to the buyer

6.2 Complaints and Automatic Purchase Completion

Problems with the name change must be reported by the buyer within 32 hours after the name change has been marked as completed by the seller. We investigate all reported problems and take appropriate action. If the buyer does not report problems with the name change within 32 hours, the purchase of the race entry will be completed and payment for the race entry will automatically be paid to the seller.

7. Prohibited Use

The following activities are prohibited:

  • Selling race entries you don't own
  • Selling the same race entry multiple times
  • Using false or misleading information
  • Circumventing our security measures
  • Abusing the platform for fraud

8. Limitation of Liability

We are not responsible for any damages you may suffer as a result of your use of the Platform, including but not limited to direct or indirect losses resulting from:

  • Event organizers' decisions or changes to their rules
  • Event organizers' decisions to cancel or postpone events
  • Buyers' or sellers' actions or failure to take necessary steps to complete transactions
  • Technical problems with third parties (e.g. Stripe)
  • We do not guarantee continuous or uninterrupted access to the Platform. Our total liability for errors or deficiencies in the Platform is limited to the amount paid by the buyer for the transaction in question.

9. Privacy

We process your data in accordance with applicable privacy laws. For more information, see the privacy policy available here: Privacy Policy.

10. Intellectual Property

All content on the Platform, including design, logos, text and program code, is protected by copyright and belongs to Startex AB. You may not use our content without prior written permission from us.

11. Account Termination

We reserve the right to terminate or restrict accounts that violate the Terms.

You can delete your account at any time under "My Profile" when logged in. Ongoing transactions must be completed before the account can be deleted.

12. Applicable Law and Dispute Resolution

The Terms are governed by Swedish law. Any disputes shall be settled by Swedish courts with Stockholm District Court as the first instance.

13. Changes to Terms

We may update the Terms from time to time. Continued use of the Platform means you accept the new terms.
